Justice Taiwo Taiwo of a Federal High Court sitting in Abuja, has dismissed a case instituted by factions in the All Progressives Congress (APC) challenging the mode of the conduct of governorship primaries in Kogi state.
With the court case out of the way, the coast is now clear for the state chapter of the APC to adopt whichever mode it wishes in conducting the primaries in the state for the November governorship election.
Also with the judgement of the court, the already recognized and validly elected Abdullahi Bello led Kogi State Executive Committee remain the authentic State Executive Committee of the APC in Kogi State.
The court in dismissing the case described it as statute-barred and academic and therefore cannot be considered.
Justice Taiwo said the case having been caught by the provisions of Section 285(10) of the 1999 Constitution(as amended) cannot be considered before the court.
Some members of the party in two separate suits sought to compel the APC to recognize the purported Haddy Ameto led Kogi State APC Executive Committee as the validly elected State Executive Committee of the party in the state. Members of the party loyal to Governor Yahaya Bello appear to have been favoured by the ruling.
